The Difference Between Wills and Trusts
Although the terms will and trust are often used together, they are in fact, two separate things.
A will is a testamentary document that goes into effect once a person dies. A will is subject to probate. A trust, on the other hand, is not subject to probate. A trust goes into effect immediately upon creation. There are a number of different kinds of trusts. One of the most common is a living trust.
